EULA - End User License Agreement

END USER LICENSE AGREEMENT (EULA) FOR VIRTUALDVR 4.xx

IMPORTANT - READ CAREFULLY: This End User License Agreement
(EULA) is a legal agreement between you (either an individual
or a single entity) and Jens Wolgast, the AUTHOR of the Software
Product (Software) VirtualDVR (version 4.xx).
The SOFTWARE PRODUCT includes computer software and “online” or
electronic documentation. This EULA is valid and grants the end
user license rights ONLY if the SOFTWARE PRODUCT is genuine,
the package is complete, and has not been altered in any way.
You agree to be bound by the terms and conditions of this EULA
by installing, copying, downloading, accessing or otherwise using
the SOFTWARE PRODUCT. If you do not agree then you may not use
or copy the SOFTWARE PRODUCT, and you must remove any and all copies
of the SOFTWARE PRODUCT from your computer system and any other type
of storage media.

Copyright laws and international copyright treaties, as well as
other intellectual property laws and treaties protect the SOFTWARE.
The SOFTWARE is licensed, not sold, which means that you do not
purchase the SOFTWARE, you are purchasing a single (1) user license,
which authorizes you to legally continue to use the software beyond
the initial forty-five (45) day evaluation period. If you wish to
legally continue to use the SOFTWARE PRODUCT beyond the EVALUATION
period you must register the SOFTWARE at www.virtualDVR.com. If you
do not wish to continue to use the SOFTWARE beyond the EVALUATION
period then you must remove any and all copies of the SOFTWARE
PRODUCT from your computer system and any other type of storage media.
UNREGISTERED SHAREWARE/DEMO VERSIONS

All UNREGISTERED versions of the SOFTWARE PRODUCT after and including
version 3.00 are SHAREWARE, and are intended for EVALUATION PURPOSES
ONLY. Individual copies of the UNREGISTERED versions of the SOFTWARE
PRODUCT may be distributed, as long as all of the files remain in their original,
unaltered state, however, it is recommended that individuals interested in
EVALUATING the SOFTWARE PRODUCT be referred to the website
www.VirtualDvr.com for a copy of the SOFTWARE to ensure that they are
receiving the most recent information and version of the SOFTWARE available.
The SOFTWARE PRODUCT may be EVALUATED by UNREGISTERED
USERS for up to forty-five (45) days. The continued use of the SOFTWARE
PRODUCT by UNREGISTERED USERS for any length of time beyond the initial
forty-five (45) day evaluation period is an unauthorized, illegal use of the software
for which you may be prosecuted to the fullest extent of the law.
REGISTERED VERSIONS

By registering and paying a registration fee, you are accepting this EULA
and will be given a non-exclusive license to use the Software VirtualDVR
without any shareware specific functional restrictions and charakteristics.
You may install the product on as many as you want OWN computers but only
one person at a time may use it. The SOFTWARE PRODUCT can only be used
by as many persons at the same time as licenses have been bought. All available
upgrades of the same major version of the SOFTWARE PRODUCT are FREE to
REGISTERED USERS. Furthermore REGISTERED USERS may receive technical
support, although it is not obligatory. Technical support is provided via E-Mail ONLY.
GENERAL

Since you have the opportunity to try the SOFTWARE PRODUCT before you
purchase it, the registration price is non-refundable. You may not
reverse engineer, decompile or disassemble the SOFTWARE. Furthermore
you may not permit other individuals to use the Software except under
the terms listed above, create derivative works based on the Software,
copy the Software (except as specified above) rent, lease, transfer or
otherwise transfer rights to the Software nor remove any proprietary
notices or labels on the Software.

UNDER NO CIRCUMSTANCES shall any party mass distribute any versions of
the SOFTWARE PRODUCT without permission from the AUTHOR of the
SOFTWARE PRODUCT. This includes but is not limited to any form of storage
media such as floppy disks, CD-ROMs, and the INTERNET.
DISCLAIMER OF WARRANTY

The Software is provided on an AS IS basis, without warranty of any kind,
including without limitation the warranties of merchantability, fitness
for a particular purpose and non-infringement. The entire risk as to the
quality and performance of the Software is borne by you. Should the
Software prove defective, you assume the entire cost of any service and
repair.

The Author of the Software IS NOT RESPONSIBLE FOR ANY INDIRECT,
SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR
MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR
LOSSES.

Title, ownership rights and intellectual property rights in and to the Software shall
remain in the Author. The license will terminate automatically if you fail to comply
with the limitations described above. On termination, you must destroy all copies
of the Software and Documentation.
